Giftcard Terms & Conditions

1. General Provisions

1.1. These Gift Card Terms and Conditions ("Terms") govern the purchase, use, and redemption of gift cards ("Gift Cards") issued by SIA "Mājas Cēsīs", registration number: 40203350498, registered address: Rīgas iela 15, Cēsis, Cēsu novads, LV-4101, Latvia ("Mājas Cēsīs", "we", "us", or "our").
1.2. By purchasing or using a Gift Card, you ("Purchaser", "Holder", or "you") agree to be bound by these Terms. Please read them carefully before making a purchase.
1.3. These Terms are governed by and construed in accordance with the laws of the Republic of Latvia, including but not limited to the Consumer Rights Protection Law and the Civil Law of the Republic of Latvia.

2. Gift Card Purchase

2.1. Gift Cards are available for purchase through our website at www.majascesis.lv with values ranging from €50 to €1,000.
2.2. You may select a predetermined amount (€50, €100, or €200) or enter a custom amount within the specified range.
2.3. Payment for Gift Cards must be made in full at the time of purchase via secure payment methods provided on our website (Stripe).
2.4. All prices include Value Added Tax (VAT) at the applicable rate in Latvia (currently 21%).
2.5. Upon successful payment, you will receive a confirmation email containing the Gift Card code and details. The Gift Card will be delivered electronically to the email address provided.

3. Gift Card Validity

3.1. Gift Cards are valid for twelve (12) months from the date of purchase.
3.2. The validity period is clearly stated on the Gift Card and in the purchase confirmation email.
3.3. In accordance with Latvian consumer protection legislation, Gift Cards cannot be extended beyond their validity period. Any unused balance will be forfeited after the expiration date.
3.4. We recommend using your Gift Card well in advance of the expiration date to allow sufficient time for booking and enjoying your stay.

### 4. Gift Card Redemption

4.1. Gift Cards may be redeemed for accommodation bookings at any Mājas Cēsīs or Konrada Nami property.
4.2. To redeem a Gift Card, enter the unique Gift Card code at checkout when making a reservation on our website.
4.3. Each Gift Card code can only be used once. The full value of the Gift Card will be applied to your booking.
4.4. If the total booking amount exceeds the Gift Card value, you may pay the remaining balance using any accepted payment method at checkout.
4.5. If the total booking amount is less than the Gift Card value, the remaining balance will be forfeited. Gift Cards cannot be partially redeemed, and no cash refund or credit will be issued for any unused portion.
4.6. Gift Cards cannot be combined with other Gift Cards in a single transaction.

### 5. Restrictions and Limitations

5.1. Gift Cards are not redeemable for cash and cannot be exchanged for money under any circumstances.
5.2. Gift Cards cannot be resold, transferred for value, or used for any commercial purpose without our prior written consent.
5.3. Gift Cards are transferable as gifts to third parties. The Holder assumes all responsibilities under these Terms upon receiving the Gift Card.
5.4. Gift Cards cannot be used to purchase other Gift Cards.
5.5. We reserve the right to refuse acceptance of a Gift Card if we reasonably believe it has been obtained fraudulently or in violation of these Terms.

6. Refunds and Cancellations

6.1. In accordance with Article 12 of the Latvian Consumer Rights Protection Law and EU Directive 2011/83/EU on consumer rights, you have the right to withdraw from the distance contract for the purchase of a Gift Card within 14 (fourteen) calendar days from the date of purchase, provided that the Gift Card has not been used or redeemed.
6.2. To exercise your right of withdrawal, you must inform us of your decision by sending a clear statement (e.g., via email to info@majascesis.lv) before the withdrawal period expires.
6.3. If you withdraw within the statutory period and the Gift Card has not been used, we will reimburse all payments received from you within 14 days of receiving your withdrawal notification, using the same payment method used for the initial purchase.
6.4. Once a Gift Card has been partially or fully redeemed, the right of withdrawal no longer applies to the used portion.
6.5. Gift Cards purchased as business-to-business transactions are not subject to consumer withdrawal rights.
6.6. If a booking made with a Gift Card is cancelled and a refund is issued according to our cancellation policy, the Gift Card code will be reactivated with the refunded amount for future use within the original validity period.

7. Lost, Stolen, or Damaged Gift Cards

7.1. Gift Cards are delivered electronically and should be stored securely. We recommend saving the confirmation email and Gift Card code in a safe location.
7.2. We are not responsible for lost, stolen, or deleted Gift Card codes. Treat your Gift Card code like cash.
7.3. If you believe your Gift Card code has been compromised, contact us immediately at info@majascesis.lv. We may, at our sole discretion, deactivate the compromised code and issue a replacement if the Gift Card has not been used.
7.4. We reserve the right to require proof of purchase before issuing any replacement.

8. Liability

8.1. To the maximum extent permitted by Latvian law, our liability in connection with Gift Cards is limited to the face value of the Gift Card.
8.2. We shall not be liable for any indirect, consequential, special, or punitive damages arising from the use or inability to use a Gift Card.
8.3. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

9. Data Protection

9.1. Personal data provided during the purchase of a Gift Card will be processed in accordance with our Privacy Policy, available at www.majascesis.lv/policy/privacy-policy.
9.2. We process personal data in compliance with Regulation (EU) 2016/679 (General Data Protection Regulation) and the Latvian Personal Data Processing Law.
9.3. By purchasing a Gift Card, you consent to receiving transactional communications related to your purchase via email.

10. Changes to Terms

10.1. We reserve the right to modify these Terms at any time. Any changes will be posted on our website and will apply to Gift Cards purchased after the date of modification.
10.2. Gift Cards purchased before any modification will remain subject to the Terms in effect at the time of purchase.

11. Dispute Resolution

11.1. In the event of any dispute arising from or in connection with these Terms or your use of a Gift Card, we encourage you to first contact us directly at info@majascesis.lv to seek an amicable resolution.
11.2. If a dispute cannot be resolved amicably, consumers may submit a complaint to the Consumer Rights Protection Centre of Latvia (Patērētāju tiesību aizsardzības centrs) at www.ptac.gov.lv.
11.3. Consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
11.4. Any disputes that cannot be resolved through the above mechanisms shall be subject to the exclusive jurisdiction of the courts of the Republic of Latvia.
